On 3 May 2023, a meeting on the topic concerning “Anti-mafia interdiction measures” was held at the “Prefetto Carlo Mosca” Conference Hall.
This event was addressed to the trainees of the XXXVIII Advanced Training Course and to those of the II Level Crime Analysis Course, as well as to several representatives of the security sector. Moreover, all the Prefetture and the representatives of the Interagency Anti-Mafia Units (GIA according to the Italian acronym) participated by videoconference.
This working session was opened by the welcome address delivered by the Scuola di Perfezionamento Director, Carabinieri Corps Major General Giuseppe La Gala and by the opening lecture delivered by Professor Giuliano Amato, President Emeritus of the Constitutional Court.
In the morning, the working session was focused on the principles regulating the anti-mafia interdiction issues as well as on the institutional countering framework drafted by the legislator. Many prominent lecturers participated in this event, such as Mr. Luigi Maruotti, President of the State Council, Professor Nicolò Zanon, Vice-President of the Constitutional Court, Mr. Antonio Corbo, Counsellor of the III Criminal Division of the Court of Cassation and Mrs. Diana De Martino, Anti-mafia and Counter-terrorism Deputy Public Prosecutor. They dealt, respectively with the following topics: “The role of administrative justice in the setting up of methods to counter organized crime”, “Freedom of economic initiative and fight against Mafia-type organizations”, “Administration and judicial control: the guidelines of the Court of Cassation” and “The structures of criminal organizations”.
During the afternoon session, the meeting, introduced and led by Prefetto Stefano Gambacurta, Deputy Director General of Public Security Department, responsible for Police Forces’ Coordination and Planning, Mr. Massimo Mariani, Prefetto of Reggio Calabria, Mr. Giuseppe Amarelli, Full Professor of Criminal Law at the Naples-based “Federico II” University, Mr. Vincenzo Salamone, President of the Campania-based Regional Administrative Court (TAR according to the Italian acronym), Mr. Antonio Matonti, Director of Legislative and Regional Affairs of Confindustria, Mrs. Giovanna Greco, Senior Officer of the National Council of Chartered Accountants and Accountant and Mr. Luca D’amore, Researcher in the field of judicial administration – seized and confiscated property sector – at the National Foundation of Chartered Accountants, took the floor. These experts analyzed the characteristics, technical and implementation aspects of interdiction measures from their professional expertise point of view and emphasized the special features of these measures, in the attempt to find the right balance between the needs of social defense and freedom of initiative.
This event represented a panel discussion to analyze the strategic value of interdiction measures in the anti-mafia administrative prevention system as well as of anti-mafia policies, taking into account that these tools are fundamental for the law enforcement sector to fight against the infiltrations of Mafia-type groups into the market and to ensure the protection of competition.
